When our then-new receptionist Gwen Clear started her first week with the Criminal Defense Team in 2014, she took a call from a client who was being investigated for murder. Unfortunately, he made 2 confessions and admitted that that the body found in his backyard was in fact his girlfriend whom he had strangled a few years earlier. Gwen has since been promoted, but will never forget that phone call as it lead to one of the wildest rides that the Criminal Defense Team has ever taken. In a case that seemed more plausible for a John Grisham novel, the lawyers and staff banded together and fought against the forces of the government. It is a long story, but in the end, a man that was facing spending the rest of his life in jail ultimately plead guilty to a class B felony and only a few years in prison after Andy Baldwin’s hour long opening statement provided a surprise twist that caused the prosecutor concern about losing. While Andy Baldwin wanted the trial to proceed to verdict, the client took a plea that would allow him to spend some time in prison, but also enough time to get out to spend time watching his daughter and grandchildren grow up. Multiple lawyers and staff members were involved in locating witnesses and interviewing them as well as preparing for trial. It certainly took a team to provide the unlikely outcome of that high-profile case.
Our lawyers have handled over 20 murder cases over the years, a high number for any private law firm. One of our partners, Mark Kamish, is also one of the few death penalty qualified attorneys in the State of Indiana. Another of our lawyers has even been on the other side of murder cases, working and going to trial as a prosecutor. Max Wiley now provides the insights he gained as prosecutor on the defense side, which is a huge advantage for our clients. When the State of Indiana is prosecuting someone for murder, it has available to it a full accompaniment of investigators, police and staff. This makes the task of the criminal defense lawyer very difficult. Fortunately, at the Criminal Defense Team we have many lawyers and staff who have hunkered down in the trenches of a murder case. This helps counter-act the power of the State of Indiana.
