If you are arrested for a second DUI, you will be facing a mandatory jail sentence, which you were not facing on your first DUI conviction. In Indiana, if you are convicted or plead guilty to a second DUI, you are required to serve at least 5 actual days in the county jail and could serve as much as 1 year or even up to 2 ½ years dependent upon whether it is filed as a felony or a misdemeanor. Also, you will be facing a mandatory 1 year license suspension vs the much shorter suspension on your first DUI. If your first DUI came within 5 years of the second arrest, then you will also be facing a felony charge. A level 6 felony carries a punishment between 6 months and 2 ½ years.
